On July 25th, an inmate transportation van from the Catahoula Parish jail was hit by a car on the Interstate 49 service road going North. Apparently the van was trying to merge onto Interstate 49 south, and made the turn without seeing the oncoming car.
The driver of the car, two security guards, and nine prisoners were sent to the hospital with mostly minor injuries. All but one were released later that day. The security guard who was not released later that day sustained traumatic head injuries, and was later transported via helicopter to a larger hospital. According to the accident report, the driver of the car did not speak English, and the driver of the security van did not have a license. Both drivers were charged with driving without a license, and the van was charged with failure to yield.
In this accident, it is very likely the security guards could collect workers compensation as well as file a suit for damages against the Parish's UM insurer. If a third party was contracted to provide transportatin, this party should also be addressed. This is an example of a case that may appear simple, but could involve mutiple avenues of recovery for the unfortunate guards involved.
