Can you recover if you have no insurance in Louisiana? What is 'no pay, no play'? Can you still collect for a serious accident even if you don't have insurance yourself?
Can you collect damages if you were injured in a car accident but you don't have any insurance in Louisiana?
In Louisiana there's what's known as the no pay, no play provision of state law. What this means is that if you don't have automobile insurance and you're involved in an accident, you can still collect damages, but you're not entitled to collect the first $10,000.00 of your damages. So even though may not have insurance in the State of Louisiana, if you're insured in an automobile accident, you can still collect damages, you're just penalized because you cannot collect the first $10,000.00 of those damages.
Call us if you have any questions about an automobile accident you may have had, how much recovery you can get, and if your insurance may cover you for that accident.
Note--this amount has now been increased to $15,000. Call for more details about this complicated, newly amended law please. It also may depend upon when your accident occurred as to which version of the law applies.
