In Louisiana there is a specific statute that allows an insured who has been injured in an automobile accident to file suit against their own insurance company. This statute is found at Louisiana Revised Statute 22, § 1220. This statute says that your own insurance company has to deal with you on a good faith basis. It applies only to any UM coverage that you have from your own insurance company. If your insurance company fails to deal with you on a good faith basis and you have UM coverage through them you may be able to file suit against them for penalties and/or attorneys' fees.
