Just think about this scenario:
A young man is leaving home for work. He travels the interstate to get to work on time at 8:00 A.M.
Meanwhile, a long-haul truck driven by an experienced driver is also on the interstate. The driver has been up since very early morning. He works for a large, major carrier.
Unfortunately he is too tired to drive. He falls asleep at the wheel after too little sleep over his last few trips on the road, and his truck crosses lanes.
His truck scrapes the side of another truck that was in the other lane. This wakes the driver up quickly but he groggily overcompensates into the left lane where the young man is driving.
The young man’s car is hit and he is forced across the median into oncoming traffic, and tragically his life ends during the ensuing crash.
When the legal case starts, one of the first things the lawyer for the young man’s family does is request the truck driver’s logbook.
The logbook says the truck had only been on the road for a couple of hours, so the lawyer looks at the truck’s GPS data and it confirms the lawyer’s suspicion that the logbook had been faked. It is apparent that the driver had driven beyond the legal limit. He is limited to 11 hours over a fourteen-hour period. Once those eleven hours have expired, the law says he must take a break for ten straight hours.
Unfortunately, this scenario can be all too real. This is just one reason you should seek competent legal advice if you find yourself in a similar situation.
